You grant Bjorn the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Bjorn for all claims resulting from content you supply.

Risk of Loss

Risk of loss and title for items purchased from Bjorn pass to you upon delivery to the carrier.

Returns, Refunds, Exchanges & Title

Please notify us within 30 days of receipt of your order if you need to return or exchange your order. If your product has been altered in any way it cannot be returned. Custom products cannot be returned. All returns are subject to a 25% restocking fee.

To return any product purchased from Bjorn Woodworks, you’ll be required to follow the procedures that apply to your circumstances, outlined below: Damage product returns and manufacturers defects: If you notice damages or defects to your order once it has been opened and you choose to return the order, you are responsible to re-package the order using the item’s original packaging materials and assure that the product is suitable for shipping. You are required to contact Bjorn Woodworks within 10 days of receiving your order. We will arrange the shipping of your damaged merchandise back to Bjorn Woodworks and will re-issue a replacement order.

 

Damaged Product Returns

All products come with a 30 day return window after date of delivery in circumstances of product failure and manufacturing defects. Failure is defined as products that are out of alignment of more than 1′′, bent during shipping, and chips in the powder coating. "Chips" are defined as areas of the powder coating where the steel beneath is exposed and will present a potential for rust. Chips created during customer installation are not covered in warranty. Additionally, due to the weight and size of our brackets, minor scuffs can occur in shipping but do not compromise the strength of the brackets and are therefore not covered under warranty.

In order for us to help with any damaged products we will need images of the damages within the first 30 days of receiving the product. Please provide this information to our customer service department immediately upon receiving your product via support@bjornwoodworks.com.

Warranty

LIMITED WARRANTY:

Bjorn warrants products to be free from defects in material or manufacturing. Our products are further warranted for adequacy of design when used in accordance with design limits and when properly specified, installed and maintained. This warranty does not apply to uses not in compliance with specific applications and installations, or to modified products.

Due to the particular characteristics of potential impact events, the specific design and location of the structure, the building materials used, the quality of construction, and the condition of the soils involved, damage may nonetheless result to a structure and its contents even if the loads resulting from the impact event do not exceed Bjorn Woodworks specifications and Bjorn Woodworks connectors are properly installed in accordance with applicable building codes.

All warranty obligations of Bjorn Woodworks shall be limited to ten (10) years for Brackets, at the discretion of Bjorn Woodworks., to repair or replacement of the defective part with provided proof of purchase. These remedies shall constitute Bjorn Woodwork’s sole obligation and sole remedy of the purchaser under warranty. In no event will Bjorn Woodworks. be responsible for incidental, consequential, or special loss or damage, however caused.

 

Customer Choice Returns

For all returns excluding damages and defects, you must repackage the order using the items’ original packaging materials assuring that the product is suitable for shipping. Customers are responsible to ship the order back, at their expense, to Bjorn Woodworks in unused and resell-able condition. You may use the shipping carrier that is most convenient for you. You are required to contact Bjorn Woodworks about the return within 30 days of receiving of your order. Merchandise returned for customer convenience is subject to a 25% restocking fee. However, because the colors you see depend on your monitor, Bjorn cannot guarantee that your monitor’s display of any color is accurate. Product Pricing

Bjorn reserves the right to modify retail prices at any time and without prior notice. All prices indicated exclude taxes, delivery (where applicable) and assembly. With respect to items sold by Bjornwoodworks.com, Bjorn cannot confirm the price of an item until you order. Despite Bjorn’s best efforts, a small number of the items in print by Bjorn may be mispriced. If an item’s correct price is higher or lower than the Bjornwoodworks.com stated price, Bjorn will, at its discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

Applicable Law & Disputes

Any dispute or claim relating in any way to your use of Bjornwoodworks.com Services, or to any products or services sold or distributed by Bjorn or through Bjornwoodworks.com Services will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

 

There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Conditions of Use as a court would.

 

Bjorn and you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration. Bjorn and you each waive any right to a jury trial. Bjorn and you also both agree that you or Bjorn may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

 

Site Policies, Modification, and Severability

Bjorn reserves the right to make changes to the Bjorn website, policies, Service Terms, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
